The process of claiming from the Road Accident Fund (RAF) can be complicated, confusing and emotional, Webbers Attorneys aims to guide their clients through the channels of claiming, providing them with high quality legal and medical expertise.

Road accident claims are those that arise from injuries and damages associated with motor accidents. Road accident and personal injury claims are also known as third-party claims and the purpose of the Road Accident Fund is to cover all road users within South Africa.

We are the experts

The Road Accident Fund Act of 1996 is a law that protects anyone using a road in South Africa against injuries suffered due to the negligence driver. To claim from the Road Accident Fund, you must prove that the driver of the other vehicle was negligent and due to the negligence you sustained injuries.

It is important when deciding whether or not to make a claim from the RAF, to consult a personal injury lawyer, in order to determine your eligibility and to prevent you spending excess money on a fruitless claim.

Webbers Attorneys - Transparent & reliable

The first step is to complete a statutory claim form. The purpose of the form is to provide a record of the date, time and location at which the accident took place, the personal details of the claimant and other parties involved in the accident, and details of the vehicles.

The personal injury claim form will also contain an affidavit containing a description of how the accident happened, witness statements and their personal details, police reports and a medical report by the treating medical practitioner and associated hospital and medical records.

We will lodge a claim on your behalf

After submitting the statutory claim form, your claim will be registered with the Road Accident Fund (RAF), at which point it will begin to examine your case.

The RAF will decide whether your claim is valid and what its merits are;

  • Who’s fault the accident was
  • The degree of negligence of the different parties involved in the accident
  • Compensation amount of damages suffered.

In order to prove a Road Accident Fund claim, you will need to show that the driver was negligent, signifying that the accident could otherwise have been avoided. The claim process is complicated, which is why it is important to consult an expert, such as Webbers Attorneys.
